Mettler Health Technologies Inc. ("Mettler Health," "we," "us," or "our") is a Texas corporation that develops healthcare software and technology for hospitals and other healthcare organizations, including behavioral health electronic health record (EHR) software, the Q15 Plus patient safety and observation platform, patient monitoring solutions, health information exchange tools, and related services.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit www.mettlerhealth.com and our related websites that link to this policy (together, the "Website"), contact us, request a demo, subscribe to our communications, or otherwise interact with us as a prospective customer, business contact, or job applicant.

By using the Website, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Website.

  • 2. Patient Health Information Is Not Governed by This Policy

This Privacy Policy does not apply to patient information that our products and services process on behalf of our healthcare customers.

When hospitals, clinics, and other healthcare organizations use our EHR, Q15 Plus, patient monitoring, wearable device, health information exchange, or other platforms, those organizations are typically "covered entities" under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). In that role, Mettler Health acts as a business associate. Any protected health information (PHI) we receive, including clinical records, observation and location data, and physiological data from patient wearables, is used and disclosed only as permitted by:

  • HIPAA and the HITECH Act, and their implementing regulations at 45 C.F.R. Parts 160 and 164;
  • the written Business Associate Agreement and service agreement between Mettler Health and that customer;
  • 42 C.F.R. Part 2, where substance use disorder treatment records are involved; and
  • applicable state law, including the Texas Medical Records Privacy Act (Texas Health and Safety Code Chapter 181).
  • 3. Information We Collect

Information you provide to us. When you contact us, request a demo or pricing, sign up for our email list, request support, or apply for a job, you may give us:

  • contact details, such as your name, email address, phone number, and mailing address;
  • professional details, such as your organization, job title, facility type, and size of your organization;
  • the content of your messages, questions, and any files you choose to send us;
  • account credentials, if you register for a customer or partner portal; and
  • employment information, such as a resume, work history, and references, if you apply for a position.

Information collected automatically. When you visit the Website, we and our service providers may automatically collect:

  • device and browser information, such as IP address, browser type, operating system, and device identifiers;
  • usage information, such as pages viewed, links clicked, referring website, and date and time of visits; and
  • approximate location derived from your IP address (city or region level, not precise geolocation).

Information from other sources. We may receive business contact information from trade shows, industry events, referral partners, and publicly available professional sources.

We do not intentionally collect sensitive personal information through the Website, such as Social Security numbers, financial account numbers, or health information about you.

  • 4. How We Use Information

We use the information described above to:

  • respond to inquiries and provide demos, quotes, proposals, and customer support;
  • evaluate, negotiate, and administer business relationships with healthcare organizations and partners;
  • send newsletters, product updates, and event invitations, which you may opt out of at any time;
  • operate, maintain, secure, and improve the Website, including detecting fraud, abuse, and security incidents;
  • understand how visitors use the Website so we can improve its content and design;
  • evaluate job applicants and comply with employment-related obligations; and
  • comply with legal obligations, enforce our terms, and protect the rights, property, and safety of Mettler Health, our customers, and others.

We may also create de-identified or aggregated information that does not identify any individual. We will maintain such information in de-identified form and will not attempt to re-identify it, except as permitted by law.

  • 5. Cookies, Analytics, and Embedded Content

The Website uses cookies and similar technologies, which are small files stored on your device, to make the Website work, remember your preferences, and understand how visitors use it.

Embedded services such as Google Maps may set their own cookies and collect information under their own privacy policies.

Your choices. Most browsers let you block or delete cookies through their settings. Blocking strictly necessary cookies may affect how the Website functions. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

Do Not Track and Global Privacy Control. We do not sell personal information or use it for targeted advertising, so there is nothing to opt out of for those purposes. Where required by applicable law, we will honor Global Privacy Control (GPC) signals as a valid opt-out request.

No tracking on patient-facing tools. We do not place advertising pixels or third-party tracking technologies on authenticated portals or applications used to access patient information.

  • 6. How We Share Information

We do not sell personal information, and we do not share it for targeted advertising. We disclose personal information only as follows:

  • Service providers. Vendors that host the Website, provide email, analytics, customer relationship management, and IT services on our behalf, under contracts that limit their use of the information to providing services to us.
  • Professional advisers. Lawyers, accountants, auditors, and insurers, subject to confidentiality obligations.
  • Business transfers. A buyer, investor, or successor in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to this Privacy Policy.
  • Legal and safety reasons. Government authorities or other parties when we believe in good faith that disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, property, or safety of Mettler Health, our customers, patients, or others.
  • With your consent. Any other party when you direct us to share your information.
  • We do not use or disclose personal information collected through the Website to train artificial intelligence models offered to third parties.
  • 7. Security and Data Retention

Security. We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and monitoring. No website or internet transmission is completely secure, however, and we cannot guarantee the security of information you send to us. If we learn of a security breach affecting your personal information, we will notify you as required by applicable law, including Texas Business and Commerce Code Chapter 521.

Retention. We keep personal information only as long as reasonably necessary for the purposes described in this policy, including to maintain business relationships, meet legal, tax, and accounting requirements, resolve disputes, and enforce agreements. Marketing contact information is kept until you unsubscribe or ask us to delete it. Job applicant information is kept for [two years] after the position is filled unless a longer period is required by law. When information is no longer needed, we delete or de-identify it.

  • 8. Your Privacy Rights and Choices

Rights you may have. Depending on where you live, including under the Texas Data Privacy and Security Act and similar state privacy laws, you may have the right to:

  • confirm whether we process your personal information and access it;
  • correct inaccuracies in your personal information;
  • delete personal information you provided or we obtained about you;
  • obtain a copy of your personal information in a portable format; and
  • opt out of the sale of personal information, targeted advertising, and profiling that produces legal or similarly significant effects. As stated above, we do not engage in these activities.

We extend these rights to all Website visitors regardless of location, subject to exceptions allowed by law, such as information we must keep for legal compliance.

How to submit a request. Email us at privacy@mettlerhealth.com or write to the address in Section 9. We will verify your identity before acting on a request and may ask for information to do so. You may use an authorized agent where the law permits. We will respond within 45 days, and may extend that period once by an additional 45 days when reasonably necessary, with notice to you. We will not discriminate against you for exercising your rights.

Appeals. If we decline to act on your request, you may appeal by replying to our decision or emailing privacy@mettlerhealth.com with the subject line "Privacy Request Appeal." We will respond to your appeal within 60 days. If your appeal is denied, you may contact the Texas Attorney General at www.texasattorneygeneral.gov/consumer-protection, or the attorney general of your state.

Marketing emails. You can unsubscribe from our marketing emails at any time by using the "unsubscribe" link in any email or by contacting us. We may still send you transactional or service-related messages.
